These Terms and Conditions ("Terms") govern your use of the Out N About mobile application and services ("App" or "Service") as an event organizer. Throughout these Terms, the terms "you" and "your" specifically refer to you as the event organizer. By accessing or using our App to create and manage events, sell tickets, or perform any other related activities, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1.1. By accessing or using the Out N About App and/or Website as an event organizer, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional terms and conditions referenced herein or made available by us.

1.2. We reserve the right to modify these Terms at any time. The most current version of the Terms will be posted on our website, and continued use of the Service after any changes have been made constitutes acceptance of the updated Terms.

2.1. Event Listing: You are responsible for creating and managing your event listings on the Out N About. This includes providing accurate, up-to-date information regarding event details such as date, time, location, and ticket prices.

2.2. Compliance with Laws: You agree to comply with all applicable local, national, and international laws, regulations, and ordinances in relation to your event. This includes, but is not limited to, laws related to health and safety, licensing, capacity, and noise regulations.

2.3. Permits and Licenses: You are responsible for obtaining any necessary permits, licenses, or other authorizations required for hosting your event. Out N About is not responsible for ensuring that your event complies with legal requirements.

2.4. Refund Policy: You must establish and clearly communicate your refund policy to attendees before the event. Refunds are processed according to your policy, and you are responsible for issuing any refunds that may be due. Out N About is not responsible for handling refunds unless explicitly stated otherwise.

3.1. Ticket Sales: You may use the Out N About App to sell tickets to your events. You agree that all ticket sales are final and subject to the refund policy you have established.

3.2. Fees: Out N About charges a non-refundable ticketing fee for each ticket sold through our platform. This fee is automatically deducted from the ticket price and is separate from any fees you charge. The ticketing fee is non-refundable, even in the event of a cancellation or postponement.

3.3. Payouts: Proceeds from ticket sales, minus any applicable fees, will be transferred to your designated bank account according to our payout schedule. You are responsible for ensuring that your payment details are accurate and up-to-date.

4.1. Event Content: You are responsible for all content you upload or share on the Out N About App, including text, images, videos, and other materials related to your event. You warrant that you have the rights to use and share all content associated with your event.

4.2. License to Use Content: By uploading content to the App, you grant Out N About a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, distribute, modify, run, copy, publicly display, translate, and create derivative works of your content for the purpose of promoting and supporting your event and the Out N About platform.

4.3. Intellectual Property Rights: All intellectual property rights in the Out N About App, including software, logos, trademarks, and content, remain the property of Out N About or our licensors. You may not use these rights without our express permission.

5.1. Monitoring: Out N About reserves the right, but is not obligated, to monitor communications and content within the App. This includes content posted by event organizers and interactions with users.

5.2. Organizer Responsibility: You are solely responsible for your behavior, actions, and content on the Out N About platform. Out N About is not liable for any disputes, claims, or issues arising from your event or your interactions with attendees.

5.3. Reporting Issues: If you encounter any issues, inappropriate behavior, or concerns related to your event or interactions with attendees, please contact Out N About immediately so we can address the situation appropriately.

6.1. Cancellation/Postponement Notice: If you need to cancel or postpone an event, you must notify all ticket holders through your own means of communication (e.g., email, phone, or other direct contact methods). You are responsible for providing alternative arrangements or issuing refunds in accordance with your stated refund policy.

6.2. Refunds: Out N About is not obligated to assist with processing refunds. If refunds need to be made and Out N About chooses, at its sole discretion, to assist with the refund process, the total amount to be refunded must first be transferred to Out N About before any refunds are issued. Out N About will then facilitate the refund to the ticket holders on your behalf.

6.3. Out N About Liability: Out N About is not responsible for any losses, damages, or costs associated with the cancellation or postponement of your event.

7.1. External Links: If you, as an event organizer, provide external links within the App, you do so at your own risk. Out N About does not assume responsibility for the content of these links or the risks associated with them. It is your responsibility to ensure that any external content you share complies with applicable laws and does not pose any harm to users.

7.2. Third-Party Content: Out N About does not monitor, control, or take responsibility for content shared via external links or third-party websites. You agree that any reliance on such content is at your own discretion.

8.1. No Warranties: Out N About is provided on an "as-is" and "as-available" basis. We disclaim all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2. Limitation of Liability: Out N About shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Service or your event.

9.1. Termination by Us: We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion.

9.2. Termination by You: You may terminate your account at any time by discontinuing your use of the Service and notifying us in writing.

10.1. These Terms shall be governed and construed in accordance with the laws of Scotland, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or your use of the Service will be resolved exclusively in the courts of Scotland.
